Ice Express Legal Terms

Website-ready combined Terms of Service and Privacy Policy | Effective August 10, 2026

These legal terms apply to the Ice Express website, customer inquiries, service orders, and the internal QuickBooks integration described below. A signed Service Agreement, order form, proposal, or payment schedule may contain additional event-specific terms.

Terms of Service

Last updated: August 10, 2026

1. Acceptance and scope

These Terms of Service (the “Terms”) are an agreement between Ice Express (“Ice Express,” “we,” “us,” or “our”) and each person or organization that visits iceexpress.com, requests a quote, places an order, signs a Service Agreement, or uses our services (“Customer,” “Consumer,” or “you”). By using the website or ordering services, you agree to these Terms. If you act for an organization, you represent that you have authority to bind it.

For an event or delivery, the signed Service Agreement, accepted quote, order form, and payment schedule are incorporated into these Terms. If there is a conflict, the document that is more specific to the order controls for that order.

2. Services and product characteristics

Ice Express sells and delivers bagged ice and may finely crush and blow ice by machine to create manmade “snow.” We may also provide snow slides and related equipment when stated in the order. Manmade snow is not naturally occurring snow. Area conditions, weather, and temperature can affect its appearance, consistency, longevity, and quality.

We may review the event area using mapping services and customer-supplied photographs, and may schedule a site visit if we consider one necessary. Because of equipment size and weight, we will not drive equipment on unpaved or unstable surfaces. Each party must promptly report any inability to follow agreed instructions so that mutually acceptable options can be considered.

3. Quotes, orders, and changes

Services, quantities, timing, equipment, special instructions, tax, deposit, and balance due are determined by the applicable quote or signed Service Agreement. An order is not final until accepted by Ice Express and any required deposit is received. Event completion and start times must be accurate when the agreement is signed. Later changes are subject to availability and may result in a reprocessing charge, including the charge stated in the signed Service Agreement.

4. Payment and taxes

Unless the applicable order states otherwise, the full balance is due before the event date and before Ice Express arrives or begins snow blowing. Accepted payment methods may include cash, check, ACH, purchase order for eligible governmental entities, or credit card. A credit-card or online-payment surcharge may apply if disclosed in the payment schedule. Prices are subject to applicable sales tax. A tax-exempt customer must provide a completed and signed exemption certificate when placing the order.

The Customer is responsible for the full agreed amount except where the signed Service Agreement or these Terms expressly provide a cancellation or refund right.

5. Cancellation and rescheduling

Except for the circumstances described below or in the applicable order, Ice Express must receive written cancellation notice at least two weeks before the event. Otherwise, the deposit will be forfeited, and the Customer may also be charged for equipment or construction provided before cancellation.

If circumstances beyond the Customer’s control prevent the event, including adverse weather, an epidemic or pandemic, or governmental action, Ice Express will refund payments previously received less the deposit; the Customer will not be liable for additional expenses or damages, and the order will be treated as void. Rescheduled dates and times are not guaranteed and are subject to availability and previously scheduled events.

6. Timing, delays, and late arrival

Ice Express works to meet agreed completion times but is not responsible for delays caused by traffic, construction detours, weather, equipment malfunctions, or other unforeseen occurrences. If Ice Express arrives late, the Customer may refuse the order and receive a refund of the deposit. If the Customer accepts the order after a late arrival, the Customer remains responsible for the full balance due and the agreed price for all ice used.

7. Equipment failure

If equipment failure occurs during the event, the Customer will be charged only for bags of ice used, and Ice Express will refund the amount attributable to unused bags as soon as reasonably practicable.

8. Customer responsibilities and safety

The Customer assumes responsibility for all bags of ice delivered and for safe conditions at the event during and after delivery. The Customer may count bags before snow blowing and may reasonably direct snow blowing, subject to site conditions and safety requirements.

When a snow slide is provided, the Customer must comply with the signed Service Agreement and all instructions from Ice Express, including:

  • Provide continuous adult supervision and at least four competent people to operate the slide: one at the top, two at the bottom, and one to return sliding devices.
  • Orient the slide away from drop-offs, trees, streets, traffic, and other hazards, or install adequate safety barriers.
  • Require shoes; require riders to remain seated, feet first, with both hands on the sliding device; and allow only one rider sequence at a time.
  • Prohibit horseplay and sitting, standing, or hanging on safety railings; adjust operations or discontinue use if an unsafe condition appears.
  • At the end of the event, secure the slide using the chain guard provided by Ice Express.

The signed Service Agreement may contain additional requirements, including accompaniment of young children and rotation of slide-operation duties. Safety instructions control over convenience or event scheduling.

9. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICES, PRODUCTS, WEBSITE CONTENT, MANMADE SNOW, AND EQUIPMENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” SUBJECT TO THE EXPRESS COMMITMENTS IN A SIGNED SERVICE AGREEMENT. ICE EXPRESS DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

10. Release, limitation of liability, and indemnity

To the extent permitted by law, the Customer releases Ice Express and its agents, servants, and employees from liability for injury or damage arising directly or indirectly from contact with or use of products delivered by Ice Express during or after the event, except to the extent caused by Ice Express’s negligence or willful misconduct.

To the extent permitted by law, the Customer will defend, indemnify, and hold harmless Ice Express and its agents, servants, and employees from third-party claims arising directly or indirectly from the Customer’s event or use of Ice Express products or equipment, except to the extent caused by Ice Express’s negligence or willful misconduct. These provisions do not limit liability where limitation is prohibited by law.

11. Website and third-party services

Website materials are provided for general information and may be updated without notice. Names, logos, photographs, text, and other materials owned by Ice Express may not be copied or used without permission except as allowed by law. The website or our internal operations may rely on third-party services, including Intuit QuickBooks, Zapier, mapping services, payment processors, and hosting providers. Their services are governed by their own terms and privacy practices.

12. Disputes, governing law, and attorneys’ fees

The parties may use alternative dispute resolution administered by the Better Business Bureau of Greater Houston. The laws of the State of Texas govern these Terms and each order, without regard to conflict-of-law principles. In an action between the parties, the prevailing party is entitled to recover reasonable attorneys’ fees and costs to the extent permitted by law.

13. General provisions

These Terms together with the applicable signed Service Agreement, quote, order form, and payment schedule constitute the entire agreement concerning the applicable services and supersede prior oral or written statements on the same subject. A signed Service Agreement may be amended only in a writing signed by both parties. If any provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. Headings are for convenience only.

14. Changes and contact

We may revise these website Terms by posting an updated version and changing the “Last updated” date. Changes do not retroactively alter a signed Service Agreement unless both parties agree in writing.

Privacy Policy

Effective and last updated: August 10, 2026

This Privacy Policy explains how Ice Express collects, uses, discloses, and protects personal information through iceexpress.com, customer communications, event-service transactions, and its private internal QuickBooks integration. It does not replace the privacy policies of Intuit, Zapier, payment processors, or other third parties.

1. Information we collect

Depending on how you interact with us, we may collect:

  • Contact and identity information, such as name, organization, email address, telephone number, billing address, and event contact details.
  • Event and service information, such as event date, location, timing, site photographs, special instructions, snow quantity, equipment selections, and safety or access details.
  • Transaction and accounting information, such as quotes, invoices, deposits, balances, payment method, tax status, purchase orders, refunds, and transaction history. Payment-card details may be handled directly by a payment processor rather than stored by Ice Express.
  • QuickBooks information authorized for the private integration, such as customer, vendor, invoice, payment, item, and related accounting records necessary for Ice Express’s internal bookkeeping and workflow automation.
  • Website and device information, such as IP address, browser type, pages requested, referral information, and basic cookies or logs generated by the website or hosting provider.
  • Communications and other information you voluntarily provide by telephone, email, forms, contracts, photographs, or other interactions.

2. Sources of information

We collect information directly from customers and their representatives; from Intuit QuickBooks when an authorized Ice Express administrator connects the private integration; from Zapier and other vendors that process information for us; automatically from website technologies; and from publicly available mapping or business sources where appropriate for event planning.

3. How we use information

We use information to:

  • Respond to inquiries, prepare quotes, schedule and deliver services, assess site accessibility and safety, and communicate about events.
  • Create and manage customer, invoice, payment, refund, tax, and accounting records.
  • Operate the private QuickBooks/Zapier workflow and synchronize authorized business records for Ice Express’s internal accounting and administration.
  • Process payments, collect amounts due, prevent fraud, troubleshoot, secure our systems, and maintain business records.
  • Comply with law, enforce agreements, establish or defend legal claims, and protect customers, employees, Ice Express, and others.
  • Maintain and improve our website, services, and business operations.

4. QuickBooks integration

The QuickBooks integration is private and intended for Ice Express’s internal business operations; it is not offered as a public software service. When an authorized administrator connects it, the integration may retrieve, create, update, or transmit accounting records through Intuit’s application programming interfaces and Zapier’s automation platform. Ice Express uses QuickBooks data only for the internal operational purposes described in this Policy and does not sell it or use it for interest-based advertising.

Access is limited to the permissions authorized in the connection. An authorized administrator may disconnect the integration through the connected-app settings in QuickBooks or by contacting Ice Express at michael@iceexpress.com. Disconnecting stops new API access but does not automatically delete records that Ice Express must retain for accounting, contractual, security, tax, or legal purposes.

5. How we disclose information

We may disclose information:

  • To vendors that perform services for us, including Intuit, Zapier, website hosting, communications, mapping, payment processing, accounting, IT support, security, and professional advisers, subject to their applicable agreements and responsibilities.
  • To event venues, subcontractors, delivery personnel, or customer representatives when reasonably necessary to perform requested services.
  • To governmental authorities or other parties when required by law or reasonably necessary to protect rights, safety, property, investigate misconduct, or respond to legal process.
  • In connection with a merger, financing, sale of assets, reorganization, or similar business transaction, subject to appropriate protections.
  • At your direction or with your consent.

Ice Express does not sell personal information and does not share personal information for cross-context behavioral advertising.

6. Retention

We retain information for as long as reasonably necessary for the purposes described in this Policy, including providing services, maintaining accounting and tax records, resolving disputes, enforcing agreements, meeting legal obligations, and maintaining security. Retention periods vary by record type and legal requirement. When information is no longer required, we take reasonable steps to delete, de-identify, or securely dispose of it.

7. Security

We use reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, or alteration. No transmission, integration, or storage system is completely secure, and we cannot guarantee absolute security. Customers should not send payment-card numbers or other highly sensitive information by ordinary email unless specifically instructed through a secure method.

8. Your choices and requests

You may ask to access, correct, or delete personal information that Ice Express maintains about you, or ask questions about its use, by contacting michael@iceexpress.com. We may need to verify your identity and may retain information where permitted or required for contracts, accounting, taxes, fraud prevention, security, legal claims, or compliance. You may opt out of non-transactional marketing messages using the instructions in the message, if any; service and account communications will still be sent as necessary.

9. Cookies and browser controls

The website and its providers may use essential cookies, logs, and similar technologies for site operation, security, and basic analytics. Browser settings may allow you to block or delete cookies, although doing so can affect site functionality. Ice Express does not currently respond to browser “Do Not Track” signals in a uniform manner.

10. Children’s privacy

Our website and services are directed to adults and organizations, not children under 13. We do not knowingly collect personal information directly from children under 13 through the website. Event organizers are responsible for obtaining any permissions required before providing information or images concerning minors.

Ice Express operates in Texas, and information is processed in the United States. Links to or integrations with third-party services are governed by those parties’ privacy policies. Ice Express is not responsible for third-party privacy practices.

12. Changes and contact

We may update this Policy to reflect changes in our practices, technology, legal requirements, or services. We will post the updated version and revise the effective date. Material changes will apply prospectively unless otherwise permitted by law.
